Alabama Philips DreamStation CPAP

If you are among the many people who have obstructive sleep apnea and need a CPAP machine to get a good night’s rest, you should be aware of an ongoing medical device recall and developing litigation.

The FDA has announced that Philips Respironics, a subsidiary of the healthcare and electronics conglomerate Philips, was recalling more than a dozen different models of its Continuous Positive Airway Pressure (CPAP) machines, Bi-Level Paper (BiPAP) machines, and ventilators due to safety concerns. The medical devices are being recalled because the foam used for noise reduction may crumble and be inhaled by the user, causing serious injury. Most of the recalled devices are part of the first generation DreamStation product line.

If you’ve been injured while using a Philips Respironics CPAP machine, you may be entitled to seek compensation from the manufacturer of the defective medical device. Our Birmingham, AL product liability lawyers at Gartlan Injury Law can investigate your injury and evaluate whether you are eligible to file a CPAP injury lawsuit. We have more than 20 years of experience with personal injury claims. Contact our office for a free initial consultation.

Is There a Lawsuit Against Philips Respironics CPAP Machines?

In June 2021, the FDA announced that Philips Respironics, a subsidiary of the healthcare and electronics conglomerate Philips, was recalling more than a dozen different models of CPAP machines, BiPAP machines, and ventilators due to reported safety concerns with the devices.

The recall of the Philips CPAP and BiPAP machines is classified by the FDA as a Class I recall. It’s the FDA’s most serious type of recall. In response to the recall, the FDA is evaluating medical device reports from 2009-2021 related to the recalled machines to determine the scope of the problem.

In light of the Philips recall, consumers who used the machines and suffered harm have initiated legal action to determine what liability Philips Respironics may have for the defective machines. Medical device manufacturers are responsible for ensuring their products are thoroughly tested, safe to use, and that consumers are adequately warned of the risks involved in using the device.

If Philips Respironics is found to have failed to fulfill its legal duties to consumers, injured patients may be eligible to receive compensation for the harm they’ve suffered through a Philips DreamStation CPAP recall lawsuit. A defective products attorney at Gartlan Injury Law can evaluate whether you may qualify to seek compensation after using a Philips CPAP machine or BiPAP machine.

What Allegations Are Raised in the Philips DreamStation Recall Lawsuit?

There are two primary health concerns related to the CPAP machines, BiPAP machines, and ventilators being recalled. The concerns are related to the sound-dampening foam used in the masks patients wear while utilizing these devices. Air flows from the device and passes through the foam before it enters patients’ lungs as they breathe.

The foam is made of polyurethane, and testing has revealed that in some cases, the foam may deteriorate into small particles that collect in the tubing or mask of the device. These particles can be inhaled or ingested while patients are breathing air from the device, leading to health complications such as:

  • Headaches
  • Dizziness
  • Irritation of the eyes, skin, nose, or respiratory tract
  • Persistent coughing
  • Tightness or pressure in the chest
  • Nausea and vomiting

In addition to the more direct health effects from inhaling or ingesting small foam particles, there are concerns that toxic chemicals can be released as the foam breaks down. Patients may be exposed to these toxic chemicals, leading to complications such as:

  • Increased risk of certain types of cancer
  • Respiratory failure
  • Pneumonia
  • Chronic asthma and bronchitis
  • Auto-immune disorders
  • Pulmonary fibrosis
  • Heart attacks and heart failure
  • Strokes
  • Kidney disease
  • Liver disease
