The Gartlan Injury Law and the Law Firm of Prince, Glover & Hayes along with Troy University Dothan, LexisNexis, Freedom Court Reporting, Wiregrass Investigations, BBVA Compass and Wiregrass Investigations and Forge Consulting are proud to present a free six hour continuing legal education seminar for Alabama general practice attorneys on Friday August 30, 2013, at Troy University Dothan entitled David vs. Goliath: Maximizing Your Client’s Recovery in Automobile Wrecks. The seminar will focus on how to maximize recovery for your clients in motor vehicle accident cases.

The attendees will learn that victory in automobile crash cases is obtained through early and thorough trial preparation in each and every case from the very beginning in an effort to prove and demonstrate liability, injuries, and damages, overcome defenses, and add value to the case to maximize recovery. This puts the personal injury and accident lawyer law firm in the best position to demonstrate that full compensation in these cases serves to protect the public by sending a message that people and businesses that violate rules and expose the public to unnecessary danger will be required to pay in full measure. Trial preparation is about obtaining justice for your community and your clients, even if the case does not go to court. Sometimes retaining the services of the right medical, psychological, legal, financial, engineering, accident reconstruction, investigative, and other experts can help achieve this mission.

The seminar will be in the Harrison Room at Troy University Dothan and will be free of charge to the first sixty (60) Alabama general practice attorneys that register. Continental Breakfast, lunch and refreshments will be provided. There will also be a number of vendors in attendance.

The following is the agenda of the seminar:

8:00 am – 8:15 am – Continental Breakfast provided by BBVA Compass

8:15am – 8:30 am – Opening Remarks by Kathy Farley, Coordinator of Business & Industry Training Troy University Continuing Education Center, and personal injury and accident lawyer Aaron Gartlan of the Gartlan Injury Law in Dothan, Alabama will give an introduction and overview of the seminar.

8:30 am – 9:15 am – Demand Letters and Pre-lawsuit settlement by personal injury and accident lawyer Coe Baxter of the Law Firm of Prince, Glover & Hayes in Tuscaloosa, Alabama. Coe will give an introduction to and overview of how to draft effective demand letters and working the case up to maximize the recovery. He will provide examples to assist you in your future cases. Coe will also address automobile insurance coverage issues that can impact the value of your case such as policy limits, stacking and UIM coverage, using actual cases for reference.

9:15 am – 10:00 am – Accident Reports by personal injury and accident lawyer Matt Glover of the Law Firm of Prince, Glover & Hayes. Matt will demonstrate how to effectively use an accident report and avoid falling in the trap of making important decisions based on its content, which can potentially cost greatly especially in commercial truck wreck cases. Matt will describe from his experience of recovering over seventy-five million dollars ($75,000,000.00) on behalf of his clients how big powerful corporations like insurance companies will take every step they can get away with to minimize the payout on their claims and in some cases, doing everything to avoid paying all together. This can deny justice to the community and your clients.

10:00 am – 10:30 am – The Diamond in the Rough by personal injury and accident lawyer Aaron Gartlan of the Gartlan Injury Law. Aaron will discuss, using real cases, how to spot cases that might appear on the surface to be demand letter settlement cases. However, upon further review with the trained eye, you have a case to be cleaned, cut, polished-up and litigated.

10:45 am – 11:15am – Using technology to advance your car wreck case by personal injury and accident lawyer David Hogg of the Gartlan Injury Law. David will bring his knowledge gleaned from his experience of recovering millions on behalf of his clients to speak about making technology your ally in the preparation of your automobile accident case.

11:15 am – 11:45am – Board Certified Neuropsyhchologist Michael Passler of Dothan will bring his thirty (30) years of practice providing evaluations and treatment that focuses on neuropsychological conditions to lecture regarding brain injuries. Dr. Passeler is board certified in forensic neuropsychology, psychopharmacology, and as a senior disability analyst.

11:45 am – 12:15 pm – Settlement Consultant Joe Schell of Forge Consulting in Atlanta, Georgia will present regarding medical liens, subrogation issues and structured settlements. Forge Consulting provides guidance on how to maximize a settlement or verdict recovery and ensure that potential health care or government benefit interests are properly satisfied and protected.

12:15 pm – 1:15 pm – Lunch Provided by Legal Marketing Specialist David Moyer of LexisNexis Martindale-Hubbell. David loves fishing along the coast. He has discovered that there is enough speckled sea trout (they can get real big), red fish, flounder, red snapper and Spanish mackerel to go around. 1:15 pm – 1:45 pm – Kirk Eriksen, DC of the Chiropractic Health Institute in Dothan will present regarding the diagnosis and treatment of soft tissue injuries, whip lash, cervical and lumbar spine injuries and other injuries of the back and body and the importance of shepherding medical care in an effort to make sure all of the patient’s injuries are diagnosed and treated, including the use of a network of professionals to accomplish that mission. With his unique experience and perspective, he will discuss the importance of being able to defend the diagnosis and treatment. Dr. Eriksen is a renowned lecturer and has taught doctors all across the United States, as well as Europe and Central America. He has published several research studies and has authored two landmark textbooks.

1:45 pm – 2:15 pm – Board Certified Mental Health Counselor and Licensed Professional Counselor Ray Little of Counseling Resources in Dothan will bring his thirty-five (35) years of counseling experience to lecture on the importance of diagnosis and treatment of post traumatic stress syndrome, anxiety and depression for the health and well being of your client and how vital it is in the development of a claim for pain, suffering and mental anguish. He will also emphasize with his insight the shepherding of medical care in an effort to make sure all of the patient’s injuries are diagnosed and treated, including the use of a network of professionals to accomplish that mission and being able to defend the diagnosis and treatment.

2:30 pm – 3:00 pm – Harry Weiser, MD, FAANS, FACS is a board-certified neurosurgeon at Dothan Neuroscience Center and will discuss the diagnosis and treatment of head and spinal injuries, with a focus on causation. With his vast training and over twenty (20) years of surgical experience experience, he will also show the importance of shepherding medical care in an effort to make sure all of the patient’s injuries are diagnosed and treated, including the use of a network of professionals to accomplish that mission.

3:00 pm – 3:30 pm – Principal Technical Analyst Bill Messerschmidt of Messerschmidt Safety Consultants in Birmingham, Alabama has over thirteen (13) years of experience in mishap investigation and analysis and crash reconstruction and will lecture regarding the role of the accident reconstruction expert in the trial preparation of an automobile wreck case. Bill began his career investigating vehicle crashes and mishaps as a police officer in Auburn, Alabama. In 2003, he began work as a consultant in accident investigation and reconstruction. In 2006, he founded Messerschmidt Safety Consultants with the purpose of applying scientific principles to mishap prevention and forensic accident investigations. Bill, an Auburn University alumnus, has investigated and reconstructed crashes in Alabama, Mississippi, Tennessee, Georgia, and across the United States from New York City, New York, to Los Angeles, California and has taken part in the investigation and reconstruction of hundreds of vehicle crashes and traffic accidents. He is widely recognized as one of the nation’s top experts in the forensic analysis of data from Event Data Recorders (EDR) in heavy trucks and Commercial Motor Vehicles. He developed and co-teaches How to Interpret Commercial Vehicle Event Data Recorders (EDRs) through the University of Tulsa, and he has been an invited speaker across the United States on the subject of “Black Box” or EDR data.

3:30 pm – 4:00 pm – 1:15 pm – 1:45 pm – Jim Faust of Wiregrass Investigations in Ozark, Alabama will lecture regarding the role of the private investigator in an automobile wreck case. Jim started Wiregrass Investigations in 2008. He has a Bachelor of Arts Degree in History from Troy University, a Master of Arts Degree in Management and Supervision from Central Michigan University and a Master of Arts Degree in Asian Studies from Cornell University. He retired from the United States Army as a major and during and during his twenty (20) years of service worked much of that time as a Foreign Area Officer specializing in Southeast Asia. Much of his training and experiences are in intelligence gathering and clandestine operations. He has gathered intelligence for embassies in Indonesia and Cambodia, as well as, the United Nations.
