David vs. Goliath: Maximizing Your Client’s Recovery in Commercial Truck Wreck Cases

The Gartlan Injury Law and the Law Firm of Prince, Glover & Hayes along with Troy University Dothan and Freedom Court Reporting are proud to present a free six hour continuing legal education seminar for Alabama general practice attorneys on Friday October 10, 2014, at Troy University Dothan entitled David vs. Goliath: Maximizing Your Client’s Recovery in Commercial Truck Wreck Cases.

The attendees will learn that victory in commercial truck wreck cases is obtained through early and thorough trial preparation in each and every case from the very beginning in an effort to prove and demonstrate liability, injuries, and damages, overcome defenses, and add value to the case to maximize recovery, help the client heal and protect the community. This puts the personal injury and accident lawyer law firm in the best position to demonstrate that full compensation serves to protect the public by sending a message that people and businesses that violate rules and expose the public to unnecessary danger will be required to pay in full measure. It also serves to protect the public by exacting change and conformity to safety rules and regulations in your community. Trial preparation is about obtaining justice for your community and your clients, even if the case does not go to court. Sometimes retaining the services of the right medical, psychological, legal, financial, engineering, accident reconstruction, investigative, and other experts can help achieve this mission.

The seminar will be in the Harrison Room at Troy University Dothan and will be free of charge to the first sixty (60) Alabama general practice attorneys that register. The following is the agenda of the seminar:

8:00 – 8:15 am – Continental Breakfast and registration.

8:15 – 8:30 am – Opening Remarks by Kathy Farley, Coordinator of Business & Industry Training Troy University Continuing Education Center, and personal injury and accident lawyer Aaron Gartlan of the Gartlan Injury Law in Dothan, Alabama will give an introduction and overview of the seminar.

8:30 – 9:15 am – The use of experts in commercial truck wreck cases by personal injury and accident lawyer Coe Baxter of the Law Firm of Prince, Glover & Hayes in Tuscaloosa, Alabama. Coe will give an introduction to and overview of his dedicated hands on approach to commercial truck wreck litigation and the role and use of experts in working the case up for trial in an effort to maximize the recovery. He will provide examples to assist you in your future cases.

9:15 – 10:00 am – Regulations that Address Driver Fitness in commercial truck wreck cases by Matt Glover of the Law Firm of Prince, Glover & Hayes. Matt will give an introduction and overview of regulations that address driver fitness and demonstrate how to effectively use these rules in trail preparation in commercial truck wreck cases. Matt will describe from his experience of recovering over seventy-five million dollars ($75,000,000.00) on behalf of his clients how big powerful corporations sometimes place value on profits and productivity at the expense of public safety and human life. This can deny justice to the community and your clients.

10:00 – 11:00 am – Attorney Advertising by Assistant General Counsel Mark Moody of the Alabama State Bar. Mark will give a one hour ethics presentation regarding attorney advertising based on his patient, steadfast and trustworthy work experience as assistant general counsel with the Alabama State Bar providing guidance to fellow attorneys in adhering to the Rules of Professional Conduct as well as prosecuting those attorneys who fall short of the ethical and legal requirements for attorneys.

11:00 – 11:15 am – Break.

11:15 – 12: 00 pm – Putting it all Together by personal injury and accident lawyer Aaron Gartlan of the Gartlan Injury Law. Aaron will discuss, using real cases, how to use the investigation and discovery to work the commercial truck wreck case up for trial in an effort to maximize the recovery and find justice. Aaron knows from vast experience that companies do not just write checks to pay injured people out of the goodness of their heart. Liability, injuries and damages must be demonstrated and proven and defenses must be overcome, in an effort to add value to the case, maximize recovery, help the injured person heal and protect the community from unnecessary danger.

1:00 – 1: 45 pm – Mediating the Plaintiff’s Case by personal injury and accident lawyer David Hogg of the Gartlan Injury Law. David will bring his knowledge and attention to detail hardworking approach gleaned from his experience of recovering millions on behalf of his clients to speak about important issues related to getting the commercial truck wreck case ready for mediation and mediating the case in an effort to maximize recovery, using actual cases for reference.

1:45 – 2:30 pm – The Commercial Truck Wreck Accident Investigation and Reconstruction by Gary Johnson. Gary is a second-generation accident reconstructionist with 20 years of experience in the investigation and reconstruction of motor vehicle accidents, including commercial truck wreck cases. He will lecture regarding the role of the accident reconstruction expert in evidence gathering and the trial preparation of a commercial truck wreck case, with an introduction and overview of the use of event data obtained from electronic onboard recording EOBR. Gary received a Bachelor’s Degree in Criminal Justice in 1995 from Auburn University and received a Master of Science in Mechanical Engineering from The University of Alabama at Birmingham in December of 2008, and is currently pursuing a PhD in Interdisciplinary Engineering.

2:30 – 3:15 pm – Pediatric Injuries in Motor Vehicle Collisions and Commercial Truck Wreck Cases by Kirk Eriksen, DC. Dr. Eriksen of the Chiropractic Health Institute in Dothan will present regarding the diagnosis and treatment of soft tissue injuries, whip lash, cervical and lumbar spine injuries and other injuries of the back and body and the importance of shepherding medical care in an effort to make sure all of the patient’s injuries are diagnosed and treated, including the use of a network of professionals to accomplish that mission. With his unique experience and perspective, he will discuss the importance of being able to defend the diagnosis and treatment. Dr. Eriksen is a renowned lecturer and has taught doctors all across the United States, as well as Europe and Central America. He has published several research studies and has authored two landmark textbooks.

3:15 – 3:30 am – Break.

3:30 – 4:15 pm – A View from the Bench by Circuit Judge Kevin Moulton of the 20 Judicial Circuit. Judge Moulton. Judge Moulton is a graduate of Cumberland Law School and was admitted to the Alabama Bar in 1994 and took the bench in 2010. He is a hard working dedicated circuit judge and will bring this unique perspective to give his view from the bench.

4:15 – 4:30 pm – Closing remarks by personal injury and accident lawyer Aaron Gartlan of the Gartlan Injury Law and Conclude.

Aaron Gartlan is a graduate of Troy University and the Thomas Goode Jones School of Law who focuses his practice exclusively on representing those injured by the wrongdoing of others.
